About Perki Fitness
Perki Fitness is operated by Daphne Grant, a sole trader trading as Perki Fitness.
In-person sessions are normally provided at:
Lime Cross Nursery
Herstmonceux
East Sussex
BN27 4RS
Email: perkifitness@gmail.com
These terms apply to fitness classes, private sessions, children’s and baby sessions, online sessions and blocks of sessions provided by Perki Fitness.
Bookings
Bookings may be arranged directly with Perki Fitness by email, in person or through another agreed method.
A booking is confirmed when Perki Fitness accepts it. Places may be subject to availability and suitable class capacity.
Customers are responsible for providing accurate contact information and notifying Perki Fitness of relevant changes.
Prices and payment
Current prices will be confirmed before a booking is accepted.
Individual sessions are normally paid for in person on arrival. Blocks of sessions may be paid for in advance at a reduced rate.
Unless otherwise agreed, advance payments must clear before the first session covered by the payment.
Perki Fitness may change its prices, but a price change will not affect sessions that have already been paid for.
Blocks of sessions
Blocks of sessions are personal to the customer and cannot normally be transferred to another person without prior agreement.
Unless a different period is agreed when purchased, sessions in a block should be used within six months of the purchase date.
If a refund for an unused part of a block is agreed, sessions already attended may be recalculated at the standard individual-session price before the remaining balance is refunded.
Where a statutory cancellation right applies to a block purchased remotely, the customer may have 14 days in which to cancel. If the customer asks for sessions to begin during that period, Perki Fitness may deduct the reasonable cost of any services already provided.
Nothing in these terms affects the customer’s statutory consumer rights.
Customer cancellations
Customers should give at least 24 hours’ notice if they need to cancel or rearrange a booking.
Where less than 24 hours’ notice is given, or the customer does not attend:
The full session fee may remain payable.
A session may be deducted from a prepaid block.
Perki Fitness may waive the charge where it considers the circumstances reasonable.
Cancellations should be made by email or through another contact method agreed with Perki Fitness.
Cancellations by Perki Fitness
Perki Fitness may cancel, rearrange or alter a session because of illness, unsafe conditions, insufficient attendance, venue problems or circumstances outside its reasonable control.
Where Perki Fitness cancels a prepaid session, the customer will be offered an appropriate:
Rearranged session;
Credit against a future session; or
Refund for the cancelled session.
Perki Fitness is not responsible for associated costs such as travel, childcare or loss of earnings.
Late arrival
Customers should arrive in sufficient time to begin safely.
A late arrival may result in a shortened session or refusal to participate where joining late would be unsafe or disruptive. The full session fee may still be payable.
Health and suitability
Physical activity involves an inherent risk of discomfort, strain or injury.
Customers must tell Perki Fitness about any injury, medical condition, pregnancy, recent treatment, medication, disability or other circumstance that may affect safe participation.
Customers should obtain advice from an appropriate healthcare professional before participating if they are unsure whether an activity is suitable.
Instructions, safety guidance and requests to stop or modify an activity must be followed. Participants should stop exercising and notify the instructor immediately if they experience pain, dizziness, unusual shortness of breath or other concerning symptoms.
Perki Fitness does not provide medical diagnosis or treatment, and its services are not a substitute for professional medical advice.
Children and babies
A parent or legal guardian must arrange bookings for anyone under 18.
A parent or guardian must remain present and responsible for the child or baby throughout the session unless a different arrangement has been expressly agreed in writing.
The parent or guardian must provide relevant health, accessibility and emergency information and follow all instructions relating to the child’s safety and participation.
Online sessions
Customers joining an online session are responsible for:
Choosing a safe and suitable space.
Removing trip hazards and other obstructions.
Using suitable equipment.
Ensuring their device and internet connection work correctly.
Positioning the camera where the instructor can reasonably observe them.
Stopping if an activity feels unsafe or unsuitable.
Perki Fitness cannot inspect or control the customer’s remote environment.
Conduct and safety
Customers must behave respectfully towards the instructor, other participants, venue staff and visitors.
Perki Fitness may refuse or end participation where conduct is unsafe, abusive, disruptive or inappropriate. A refund will not normally be given where a session is ended for these reasons.
Smoking, alcohol and recreational drugs are not permitted during sessions. Anyone who appears unfit to participate safely may be refused entry.
Personal belongings
Customers remain responsible for their personal belongings. Perki Fitness is not responsible for loss, theft or damage unless caused by its negligence.
Results
Individual results vary according to factors including attendance, effort, health, lifestyle and personal circumstances.
Perki Fitness will provide its services with reasonable care and skill but cannot guarantee a particular physical, health or fitness result.

Subject to those protections, Perki Fitness is not responsible for loss or injury resulting from:
